Your Rights And The Responsibilities Of The Mortgage Server

One of the greatest things about America is that we believe in the rights of individuals. Our constitution was specifically written with the thought in mind that each person has "inalienable rights”, that is rights that the government is not to violate. Freedom of speech, freedom of religion, rights of privacy, freedom to move about the country and live where and how you choose.

Unfortunately, many companies in America now thrive by denying individual rights. Insurance companies routinely deny claims and know that some individuals will simply accept their decision. It has become “normal” to have to fight with your own insurance provider to get even basic claims paid.

Mortgage companies regularly make favorable representations to get your loan in force, and then, when you have a problem, deny that their loan originators would ever say the things that led you to sign the documents. “Predatory lending practices” by mortgage companies are now being investigated all over the country. Buying a car, doing Internet transactions, or just making a large purchase at a local store can create major problems if anything goes wrong.

You Be Aware will help you find the appropriate rules and regulations and provide the tools you need to make sure that you are prepared to deal with companies who attempt to ignore your rights as a consumer. Where the need arises, YBA will recommend consumer organizations that provide additional consumer assistance.

We believe that some areas of concern are best left to attorneys to sort out the issues and take the appropriate legal action. We think mortgage documents, major insurance claims, and some credit problems fall into that category. Because of that, YBA doesn’t provide legal advice, review of specific insurance claims, or have direct contact with an individual’s creditors.

While it is always an option for our members to represent themselves in legal matters, common sense would suggest that retaining a specialist for the major problems is a better choice. When choosing an attorney, the main priority should be to find one that is already experienced in the area of concern, and can show they have achieved good success in their cases. YBA members can be sure that if we have retained an attorney to represent the needs of our members we have “checked them out”.

The YBA website provides generic information which helps our members understand their rights and educates them on basic issues. Our mortgage workshops are led by an attorney who will not only inform you, but will also represent you when appropriate.

Perhaps most important, YBA can empower you to stand up for your rights. Having rights is pointless if you don’t exercise them. Sometimes we suffer simply because we aren’t aware that our rights are being violated. At other times we just don’t understand how to enforce the rights we are aware of. YBA can be the catalyst to empower you to stand up to the companies that try and take advantage of you. By yourself, you’re just one voice. Becoming a member of our group multiplies your voice on each issue and adds leverage to help solve even the more difficult problems.
