As a You Be Aware member you have the opportunity to attend one of the many workshops which are conducted throughout Florida. The focus of the workshop is your home mortgage. They are designed primarily to provide our members with the education, knowledge and tools they need to defend a home foreclosure lawsuit or understand the rights they have if they are upside down in their home. In many cases you can stop the foreclosure process dead in its tracks if you have the correct information and education and you may have legal recourse against your lender if you owe more than your home is worth. At worst, you can ensure that you are given the time and opportunity to properly defend yourself and exercise your rights.

No matter what your reason for falling behind on your mortgage payments, or your current situation, you have rights and our workshop will explain those rights to you in an easy to understand format. If you are not behind on your mortgage but are upside down in your home this valuable workshop will explain your rights and possible recourse. You will also learn about the options you have in pre-foreclosure and foreclosure to keep your house, defend yourself, or gain the time you may need to dispose of the property and preserve your credit.

You will learn how to examine your mortgage documents so you will better understand your options based on your personal situation. For instance, you need to know if your mortgage agreement is even legal. It might surprise you to know that a high proportion of home owners have major discrepancies in their mortgage documents. Certain discrepancies in your documents such as violations of the Truth In Lending Act can void your mortgage with the lender and even render them liable for fraud in some cases. You need to know if this applies to you and how to proceed if it does.

Even if you’re not in foreclosure you may be upside down in your home. In other words your loan amount is higher than what your house is worth in today’s market. If you are in this position, you are not alone, and you are not necessarily stuck with the situation. The workshop will help you understand that there are ways to change the situation you are in. You may even be in a position to take action against your lender for violations of federal legislation in your mortgage.
