Foreclosure Road Block

Did you know that federal law protects consumers from misleading lending practices by home mortgage companies? Under one such law, The Truth in Lending Act, lenders are required to fully and accurately disclose all of the details of the mortgage agreement and other types of consumer loans. When a lender doesn't comply with the Truth in Lending Act, you may be able to rescind or renegotiate the loan without damaging your credit.

Did you know that the lender foreclosing on your home may not have a legal right to do so? In many cases the lender servicing your mortgage is not the owner of the "Note" and under the law may not have any legal right to foreclose on you. A simple examination of your mortgage documents to identify the entity that has a right to sue you in foreclosure could delay the process or even stop foreclosure.

Members of You Be Aware have access to information that arms those facing home foreclosure and debt problems with helpful information that may assist you in understanding the law so you can discuss matters intelligently with your lawyer. If you believe your mortgage company may not have complied with the Truth in Lending Act, you should check out our "Document Audit" service. This service examines your mortgage documents for errors, omissions and predatory lending practices that could be used to force your lender to restructure your mortgage in your favor or even rescind the mortgage altogether.

If your lender failed to comply with all of the requirements of the Truth in Lending Act, you may be able to use these errors and other favorable laws to stop foreclosure of your home and fight back to restructure your loan in your favor.

What Are Truth In Lending Act Violations? Here are examples of lending practices that are illegal under the Truth in Lending Act (also known as TILA):

  • Failure to disclose annual percentage rate and payment amounts
  • Failure to disclose prepayment penalties, due dates and late charges
  • Failure to disclose service or loan application fees
  • Failure to write in an expiration date of your notice of right of rescission (right to cancel) on the loan document

This is only a partial list of Truth in Lending Act violations. If you are facing home foreclosure or debt problems and feel you have been taken advantage of, or if you're behind on your mortgage payments and concerned about what can happen to your family, you need to become a member of You Be Aware and let the "Power In Numbers" work for you and your family.
