Legal Services Program Summary and Agreement

Our Agreement with You

You Be Aware LLC is a for-profit Florida Limited Liability Company. We provide as part of our many services an optional limited legal services program to members through licensed attorneys who provide the services described herein.

We are not attorneys and do not offer legal services or legal advice. If you want the optional limited legal services discussed on the Site, you must sign-up for the Plan provided by the attorneys. Not all legal services are provided and you may need to hire a private attorney.

Before you sign any agreement with us or referred attorneys, read this Agreement carefully so you will know what services will and will not be provided, as well as the full terms and conditions posted on the Site.

Summary of Program

YBA may offer a limited benefit legal services program to its members in good standing. The Plan is limited to:

(a) our members

(b) who own real property in the State of Florida

(d) pay the appropriate membership fee(s), and

(e) meet the attorney’s requirements for representation.

Each participant in the program is entitled to:

Participate on one or more telephonic consultations with the attorney to discuss the legal issues mortgage-holders face;
Limited Representation provided you meet the attorney’s criteria for legal representation,
The option to retain the attorney at discounted rates from the attorney’s customary and usual fees.

Not all real estate mortgage-related issues will be accepted by the attorneys for representation. YBA’s Plan is designed to provide discounted services for our members through the “power of large numbers”. While no two legal claims are the same; the Plan is designed to aggregate members’ claims that have similar legal issues in such numbers that the attorneys are able to offer discounted services.

REPRESENTATION OF LEGAL CLAIMS

The attorney will discuss many issues relating to member’s mortgages; however, cases will be segregated into three primary areas of the Law:

Those with predatory lending claims, including but not limited to being “up-side down” in their property value verses their mortgage amounts;
Those members who are currently in foreclosure;
Those members who are behind in their payments, but are not yet in foreclosure

Through the “power of large numbers” the attorney has agreed to represent those members described above at reduced rates. In addition to the Plan Membership fee, those members desiring to retain the attorney will have additional fees and costs under the attorney’s retainer agreement. A retainer agreement will be presented to you by the attorney once he/she has evaluated your case.

Ending this Agreement

You may end this Membership Agreement at any time, for any reason. You Be Aware, LLC must end this Agreement if we learn of any continuing perjury, fraud, or other dishonest act. We may end this Agreement if we believe you have not fulfilled an important obligation of this Agreement, or for other good cause, ethical issues, or other reason authorized by law. We may also end this Agreement if:

You are unreasonably difficult to deal with, such as being rude to the attorney, and staff
You are impeding the progress of the attorney’s assistance, or not following the attorney’s instructions.
You Be Aware, LLC believes you have not been truthful and may perjure yourself in court.
Communication between you and attorney has broken down.

Member’s Informed Consent & Your signature below means:

You have read this Agreement and the terms and conditions on the Site carefully and understand it,
You have considered the additional information and advice that the attorneys have given you,
You certify that your mortgage-related issues have a proper purpose and are supported by the law and that you are not using the legal process to harass another person or cause delay or extra expense,
You understand the possible risks and benefits of the limited-service representation described in this Agreement, and
You voluntarily, knowingly and intentionally enter into this Agreement with You Be Aware, LLC. and the attorneys as the case may require
